WHAT TO EXPECT
Estate plans are created, in part, to avoid probate. Probate is the court system by which property and assets are legally transferred after one’s death. It is also where matters are litigated if a Will or Trust is contested.
Administering an estate through probate is costly and time consuming.
Probate administrator’s and attorney’s fees are set by statute and approved by the court. Basic fees are based on the value of the assets needing to go through probate. Probate Code §§ 10810, 10811.
Contested probate matters in litigation are billed at an hourly rate.
